for Developer Series Software and Documentation published by Wolfram Research, Inc.

Acceptance. CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS BEFORE USING THIS VOLUME OF THE MATHEMATICA® APPLICATIONS LIBRARY. USE OF THIS VOLUME OF THE MATHEMATICA APPLICATIONS LIBRARY INDICATES YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU ARE NOT WILLING TO ACCEPT THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU SHOULD RETURN THE ENTIRE PRODUCT, WITH THE MEDIA ENVELOPE UNOPENED, TO THE PLACE FROM WHICH IT WAS OBTAINED FOR A REFUND OF THE PURCHASE PRICE.

Definition. The term Product as used in this agreement refers to the entire contents of this volume of the Mathematica Applications Library, including the software contained in this media envelope and associated documentation. The term Licensee refers to you.

Ownership. MathConsult Dr. R. Mäder owns the copyright to the Product. Wolfram Research, Inc. (henceforth referred to as "WRI") is the exclusive, worldwide distributor of the Product.

Mathematica Required. In order to use this Product you must use Mathematica, a software product licensed by WRI. The box indicates the supported version(s) of Mathematica. This Product does not contain Mathematica nor does it grant you a license to use Mathematica; a license to use Mathematica must be obtained separately. WRI does not guarantee that this Product will operate in conjunction with versions of Mathematica other than those listed on the box. WRI does not guarantee that this Product will be compatible with future releases of Mathematica.

Permitted Uses. Provided that you accept and abide by the terms of this agreement, WRI grants you a non-exclusive license to use this Product. This license allows you to:

install and run the software on a single computer;
maintain an archival copy of the software on off-line storage media (such as diskettes);
transfer the license to use this Product to another individual provided that:

you notify WRI in writing of your decision to transfer this license and certify that you have destroyed or given to the transferee all copies of the software and other elements of the Product (including any updates) that you have ever had;
the transferee accepts all the terms and conditions of this license agreement.

Prohibited Uses. All uses of the Product not specifically allowed in the Permitted Uses section of this agreement are prohibited. The following is a partial list of prohibited uses of the Product. Unless waived elsewhere in this agreement, this license does not allow you to:

install and/or run the Product on more than one computer;
use the Product on a computer that does not have a Mathematica license associated with it;
decompile or reverse engineer the software;
modify the Product's object code or documentation in any manner;
sublicense, sell, lend, lease, or rent the Product or any portion of the Product;
copy or allow copying of the Product, except as permitted for the maintenance of an archival copy of the Product;
authorize access to the Product other than to the Licensee. This includes, but is not limited to, access through public internet sites.

LIMITED WARRANTY. MathConsult Dr. R. Mäder and WRI warrant that the Product shall be free from defects in the physical media for a period of ninety days following date of purchase when used under normal conditions. The foregoing warranty is in lieu of all other warranties, express or implied. MathConsult Dr. R. Mäder and WRI do not warrant that the Product is free from all bugs and omissions; the Product is sold as is. User improvements and changes to the product should be made at your own risk; such changes may not be compatible with future versions of the Product.

MATHCONSULT DR. R. MÄDER AND WRI MAKE NO REPRESENTATIONS, EXPRESS OR IMPLIED, WITH RESPECT TO THE PRODUCT, INCLUDING WITHOUT LIMITATIONS, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED. MATHCONSULT DR. R. MÄDER AND WRI DO NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE PRODUCT WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE PRODUCT WILL BE UNINTERRUPTED OR ERROR FREE.

Some states do not allow the exclusion of implied warranties, so this may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state. This license agreement shall be construed under the laws of the State of Illinois.

LIMITED DAMAGES. IN NO EVENT SHALL MATHCONSULT DR. R. MÄDER, WRI, OR THE LICENSORS, DISTRIBUTORS, OR DEALERS OF WRI, BE LIABLE FOR ANY LOST PROFITS, LOST BENEFITS, OR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, WHETHER IN CONTRACT OR IN TORT, EVEN IF WRI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. DIRECT DAMAGES ARE LIMITED TO THE AMOUNT OF THE PURCHASE PRICE PAID FOR THE PRODUCT. Some states do not allow certain limitations of damages; therefore, the above limitations may not apply to you.
